General Terms and Conditions (GTC) for the auctions on bringts.ch

1. General and scope

1.1 These Terms and Conditions regulate the conditions for participation in auctions on the bringts.ch platform. By registering and participating in auctions, both buyers and sellers accept these Terms and Conditions.

1.2 The operator of the platform is bringts GmbH, Steinrain 18, 4112 Flüh (hereinafter referred to as “bringts”).

1.3 Participation in the auctions and the shipping of the products are limited to Switzerland, Liechtenstein and Germany.

2. Participation in auctions

2.1 Seller:
- Any user registered with bringts.ch from Switzerland, Liechtenstein or Germany can offer products for auction as a seller.

- Submitted products must comply with the categories “rare and rare spirits” or comparable quality standards. bringts reserves the right to reject products that do not meet these standards.

- Auction goods from private sellers are marked as such in the shop.

- The seller sets a minimum price (starting price). A commission of 10% is charged on this minimum price, which serves as a fee for bringts. In addition, a flat rate of CHF 20 is charged for shipping. This includes shipping from the seller to bringts.ch and, after checking, shipping to the bidder. These costs are included in the minimum price.

- Products from private sellers that comply with bringts' rules will be published within approximately 10 days.

- The seller assures that the products offered are genuine and in the condition described.

2.2 Buyer:

- Any registered user from Switzerland, Liechtenstein or Germany can place bids.

- Bids are binding and oblige the highest bidder to purchase.

- The auction is anonymous. Buyers and sellers remain anonymous.

2.3 Regional regulations:

- Seller and buyer undertake to comply with the legal regulations of their respective countries regarding the sale, purchase and shipping of alcoholic products.

3. Auction procedure

3.1 Bidding steps:
- Bids can only be increased in fixed increments (CHF 5 or CHF 10).

3.2 Surcharge:
- The highest bidder at the end of the auction is awarded the item and is obliged to pay the bid amount.
- notifies both the seller and the buyer about the result of the auction.

4. Post-auction settlement

4.1 After the knockdown, the seller is obliged to send the product to bringts. bringts will check the product for authenticity and condition to the best of its knowledge and belief.

4.2 After successful inspection, bringts sends the product to the buyer. If the product does not correspond to the seller's specifications, bringts reserves the right to cancel the sale. The costs for this will be charged to the seller.

4.3 The shipping costs of CHF 20, which are already included in the minimum price, are handled by bringts. If the purchase is successful, the seller receives a shipping label addressed to bringts.ch. The seller sends the product sufficiently protected and packaged. Damage to the product that is rejected by the insurance company due to improper packaging is at the seller's expense.

5. Fees and payment processing

5.1 bringts’ fee amounts to 10% of the minimum price set by the Seller.

5.2 In addition, there is a shipping charge of CHF 20, which is also included in the minimum price.

5.3 The highest bidder shall transfer the auction price within 3 working days of receiving the payment request.

6. Rights and obligations of bringts

6.1 bringts provides the platform for the processing of the auctions and is responsible for the organisation, monitoring and processing of the transactions.

6.2 bringts assumes no liability for the quality, authenticity or condition of the products offered by private sellers.

6.3 bringts reserves the right to block user accounts or cancel auctions if there is a violation of the Terms and Conditions.

7. Disclaimer

7.1 bringts is not liable for direct or indirect damages resulting from the use of the platform, unless these are based on intentional or grossly negligent behavior on the part of bringts.

7.2 The Seller is liable for compliance with all legal regulations, in particular with regard to the sale and shipping of alcoholic products.

8. Data Protection

Brings guarantees the anonymity of the auction. Users' personal data is used exclusively for processing the transaction and is not passed on to third parties unless required by law.

9. Final provisions

9.1 Changes or additions to these Terms and Conditions must be made in writing.

9.2 Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected.

9.3 Swiss law applies. The place of jurisdiction is the registered office of bringts.
